These Terms & Conditions ("Terms") govern the relationship between F6 Design & Training Solution ("F6DTS", "we", "our", "us"), a BIM consulting, engineering, staffing, and training firm based in Nagpur, Maharashtra, India, and any individual, company, or organisation ("Client", "you") that engages our services, visits our website, or enrolls in any of our training programs.
By submitting an inquiry, signing a service agreement, making a payment, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
Short version: Use our services honestly and in good faith. Pay on time, respect our IP, keep shared information confidential, and let us know promptly if anything goes wrong. We'll do the same.
01Acceptance of Terms
These Terms constitute a legally binding agreement between you and F6DTS. They apply to:
- All visitors to our website at f6designandtrainingsolution.com.
- All clients who engage F6DTS for BIM consulting, engineering services, or project execution.
- All organisations that contract F6DTS for contractual staffing or workforce deployment.
- All individuals who enroll in any training program, workshop, seminar, or certification course offered by F6DTS.
If you do not agree with any part of these Terms, you should not use our website or engage our services. Continued use after any update to these Terms constitutes acceptance of the revised version.
02Services
F6DTS provides the following categories of services, each governed by a separate service agreement or enrollment confirmation where applicable:
- BIM Consulting & Engineering: BIM modeling, multi-discipline coordination, clash detection, Scan-to-BIM, construction documentation, and related project execution services.
- Contractual Staffing & Deployment: Supply of pre-vetted BIM professionals, coordinators, modelers, and engineers on a contractual basis for client projects.
- Professional Training: Structured training programs in AutoCAD, Revit, Navisworks, Civil 3D, BIM workflows, and related AEC software tools.
- Seminars & Workshops: Industry awareness and skill-building sessions conducted at colleges, institutions, and organisations.
The exact scope, deliverables, timeline, and fees for each engagement will be defined in a written proposal, work order, or enrollment letter issued by F6DTS.
F6DTS reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected clients.
03Client Obligations
To enable F6DTS to deliver services effectively, the Client agrees to:
- Provide accurate, complete, and timely information, drawings, specifications, and access to project data required for the engagement.
- Designate a primary point of contact with authority to make decisions and provide approvals on a timely basis.
- Review and provide feedback on deliverables within agreed timelines. Delays in client review may result in corresponding delays to project delivery at no liability to F6DTS.
- Ensure that any third-party software, licenses, or tools required for the engagement are properly licensed and made available to F6DTS where necessary.
- Not engage, solicit, or attempt to directly employ any F6DTS staff or deployed personnel during the engagement or within 12 months of project completion, without prior written consent from F6DTS.
- Use deliverables and services only for the purposes stated in the service agreement.
04Fees & Payment
All fees for services are as agreed in the written proposal or service agreement. Unless otherwise specified:
- Consulting and engineering project fees are payable as per the milestone schedule defined in the agreement. A non-refundable advance may be required before work commences.
- Staffing fees are invoiced monthly based on deployed hours or fixed monthly rates as agreed, payable within 15 days of invoice date.
- Training enrollment fees are due in full at the time of enrollment or as per any installment plan confirmed in writing by F6DTS.
Late payments beyond the agreed due date will attract an interest of 1.5% per month on the outstanding amount. F6DTS reserves the right to suspend services in the event of non-payment.
All fees are quoted exclusive of applicable GST or other taxes, which will be charged in addition as per prevailing Indian tax laws.
Refunds: Training enrollment fees are non-refundable once a batch has commenced. For consulting or staffing engagements, refund terms are governed by the specific service agreement. Advance payments are generally non-refundable unless F6DTS is unable to commence the agreed services.
05Intellectual Property
Unless explicitly agreed otherwise in writing:
- F6DTS-owned content: All training materials, course content, presentations, templates, methodologies, processes, software tools, and website content developed by F6DTS remain the exclusive intellectual property of F6DTS.
- Project deliverables: Upon receipt of full payment, F6DTS grants the Client a non-exclusive license to use the project deliverables for the purposes stated in the agreement. Ownership of underlying templates, libraries, and proprietary workflows remains with F6DTS.
- Client-provided data: All drawings, specifications, design data, and documents provided by the Client remain the Client's property. F6DTS will use them solely for the purpose of delivering the agreed services.
06Confidentiality
Both parties agree to keep confidential any proprietary, technical, commercial, or business information disclosed during the engagement, except as required by law, to subcontractors bound by equivalent obligations, or information that becomes publicly available through no fault of the receiving party.
Confidentiality obligations survive the termination of any service engagement for a period of 3 years from the date of disclosure.
F6DTS may reference your organisation's name and the general nature of the project in its portfolio with your prior consent.
07Training Programs
The following terms apply specifically to participants in F6DTS training programs, courses, and workshops:
- Enrollment: Confirmed only upon receipt of the enrollment fee and written confirmation from F6DTS.
- Attendance: Regular attendance is required to receive a completion certificate.
- Code of conduct: F6DTS may remove any participant whose behaviour disrupts the learning environment, without refund.
- Certifications: F6DTS does not guarantee any specific employment outcome, salary, or placement. Placement assistance is provided on a best-effort basis.
- Schedule changes: F6DTS may reschedule or reformat sessions due to unforeseen circumstances, with reasonable prior notice.
- Recording & materials: Trainees may not record sessions or reproduce course materials without explicit written permission.
08Staffing & Deployment
For contractual staffing engagements, the following additional terms apply:
- Supervision: Deployed personnel work under the functional direction of the client for project tasks, but remain employees or contractors of F6DTS for all HR, payroll, and statutory purposes.
- Non-solicitation: The client agrees not to directly hire or solicit any F6DTS-deployed personnel during the engagement or within 12 months after its conclusion, without paying a recruitment fee as agreed.
- Statutory compliance: F6DTS is responsible for compliance with applicable labour laws, PF, ESI, and statutory obligations for its own employees and contract workers.
09Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- F6DTS's total aggregate liability shall not exceed the total fees paid for the specific engagement in the 3 months preceding the claim.
- F6DTS shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
- F6DTS is not liable for delays caused by factors beyond its reasonable control.
Our deliverables are prepared with professional care and industry-standard practices. However, final design and construction decisions remain the Client's responsibility. F6DTS deliverables should be reviewed by qualified professionals before use in live projects.
10Termination
Either party may terminate a service engagement by providing written notice as specified in the service agreement. In the absence of a specific notice period, a minimum of 30 days' written notice is required.
- Termination by Client: The Client remains liable for fees for all work completed up to the termination date. Advance fees are non-refundable.
- Termination by F6DTS: F6DTS may terminate immediately if the Client breaches these Terms, including non-payment. F6DTS will refund fees for work not yet commenced, if any.
11Dispute Resolution
In the event of any dispute, the parties agree to:
- Negotiation: Good-faith negotiation within 30 days of written notice.
- Mediation: Under the Mediation Act, 2023 (India) if negotiation fails.
- Arbitration: Binding arbitration under the Arbitration and Conciliation Act, 1996, seated in Nagpur, Maharashtra, India.
These Terms are governed by the laws of India. Courts of Nagpur, Maharashtra shall have exclusive jurisdiction over any matters not subject to arbitration.
12Amendments
F6DTS reserves the right to update these Terms at any time. When changes are made, we will revise the "Last Updated" date. For material changes, we will provide advance notice to affected clients.
Continued use of our website or services after an update constitutes acceptance of the revised Terms.
